IMPORT PROCEDURES FOR FOODS/DRINKS

In China, to protect people’s health and enhance the supervision and control of food,imported foods and drinks are highly restricted by complicated administrative provisions. Therefore,to import foods or drinks into China,we are highly suggest traders to cooperate with import agents which has experience on importing foods and drinks.

*Tariff=Duty paid value × Tarrif rates

*(Tarrif)Duty paid value= CIF PRICE(FOB PRICE+FREIGHT+INSURANCE) X EXCHANGE RATES

*Value added tax=Duty paid value x VAT RATES

*(Tariff)Duty paid value=Duty paid value(tariff) + tariff + consumption tax

*Consumption tax= (Tariff’s D.P.V + tariff )÷(1- consumption tax rates)

Document preparation before custom clearance

Chinese label    

According relevant laws and regulations of china, the imported foods,drinks and wines should have its own chinese label and the chinese label should be put on record by the inspection department.

To put the chinese label on record,we need the following documents:

1、Application form

2、Original label samples

3、Original label with chinese translation

4、Chinese label

5、Certificate of origin

6、Commercial instrument copy and contact number

7、Producer’s name

8、Goods sampling: about 3-5 pcs per bill.

9、Other documents required by the Entry-exit Inspection and Quarantine Bureau(short for inspection department)

The above document should be well prepared before the goods arriving at destination port. And those documents will be handed to the inspection department.

Documents for inspection and custom clearance:

1、Agent contract/service contract, purchase contract, commercial invoice

2、Chinese label,Original label and original label with chinese tranlation

3、 Certificate of sanitary/health issued by offical department of the export country.(certificate of freesale)

4、 Certificate of origin,issued by the official department of the export country.

5、 Product analysis

6、 Fumingation certificate/non-wood packing declaration

7、 SEA/AIR WAY BILL.(Bill of lading)

8、 Other documents required by other departments.

 

MAIN PROCEDURE:

Goods arrives => apply to inspection department=>custom clearance=>pay the taxs=>examination=>release=>sample drawn=>inspect the sample and check the chinese label=>issue sanitary certificate(The owner cannot sell their goods in domestic market before they get this certificate)

(*attention:the procedure is different in some special economic zone or port. In those zone, we must finish the inspection formalities before custom clearance.)

When the goods arrives at the port,we must apply to inspection department first,and then apply to the custom. After the inspection, if the inspection found that the quality of the goods is not in accordance with national standard, these goods cannot be sold in China. They must be destroyed or returned to the export country.

The formalities of custom clearance for alcoholic drinks are the same as the other products. But sometimes, the custom will doubt that the price we declare is lower than the actual purchase price, so that they will ask us for more evidences to prove the price is exactly the purchase. If we cannot show them believable evidences, they will search their custom database on computer about this kind of product. If they find that the declare price of the same kind of product is higher than our product, they will ask us for evidences to prove the price we declare is the actual. If we cannot show any convincable documents,and then they will ask you to redeclare the price as they said.

After sample drawn, the inspection department will inspect the quality and check the details on the chinese label。including:

quality

packing

date of produce(including the format,standard format:yyyy-mm-dd)

ingredients

Besides,they will also check the following files to see if they are correctly issued:

1. certificate of health(from the export country)

2. certificate of origin

3. component analysis

4. certificate of fumingation/non-wood packing declaration

5. other documents we submitted

If the quality was not in accordance with chinese standard,the goods must be destroy or return back to the export country.

 

The advantages of putting the chinese label on record in the inspection department before we start to import the products:

1. Shorten the adjusting and examing time of the chinese label,shorten the time of storing and the tied-up time of funds, lower the cost.

 (Once there was a client whose goods was detained for more than two month because of adjusting the label time after time )

2Avoid being detroied or forced to ship the goods back to the export country because of unexpected quality problems.reduce financial loss.

3Puting the chinese label on record in the inspection department before shipping out the goods will add some extra cost to your budget.but It can cut the risk down.

Customers can design the chinese label by themselves or authorize “CICC”to design the label.To design the chinese lable for you,CICC will charge you about 500/series. For quality inspection,they will charge you according to the ingredient of the goods. To follow up the fomalities and preparing documents for you,our service fee is about RMB 500-2000(*depends on the quantity)

The period of prearranged chinese label cost us about 15 working day. When the chinese label is put on record in inspection department. We will notify you to ship out the goods. And when the goods arrive at the destination port, we will start to clear the custom and apply to inspection department. These will cost us about 3-5 working day. After the custom clearance, the goods can be deliver to your warehouse. And then we will arrange sampling and preparing for inspection departments demand. After the inspection department finish the sample inspectiong and chinese label examination and if there is no quality problems and mistakes of the documents, the inspection department will issued “certificate of sanitary”for this shippment of goods. When you get this certificatek, you get the permission to selling this batch of goods in China, otherise, you cannot sell them. The procedure is different in some special economic zone or port. In those zone, we must finish the inspection formalities before custom clearance.

The price of applying to the inspection department and follow up the procedure is

1.      first label for the same bill (RMB500-3000)

2.      From second label on (RMB500-3000 FOR EVERY SINGLE LABEL)

We will charge the above fee for the first shippment of the goods. And the next time you import the same goods, we will not charge this fee.

 

Inspection guide of imported food

A. The prepackaged food:

The importer/distributor can directly apply to the inspection department. The companies which have no inspection license should entrust a inspection agent to apply to the inspection department for them.

Apply to inspection for the first time,the importers should submit the following documents to the inspection department::

Such as: purchase contract, L/C, commercial invoice, packing list, chinese label application material [labeling audit form, Chinese label sample, original labels with Chinese translation, certificate of origin/cerificate of freesale,certificate of sanitary/ health certificate], Sometimes the inspection declarer should provide the following documents :
    1.certificate of sanitary issused by export country

2.supporing documents of sanitary or inspection report issued by third-party testing organization.

3.related testing report

4.detail documents about the veterinary drug/additive/fumigant and related testing report

5.quality certificate、instruction for use and related documents.

6. other documents required by the inspection department.

When the inspection formalities are finished. If there are no quality or other problems, the inspection departmen will issued an 《sanitary certificate》. The importers cannot sell the imported food before they get that certificate.

Second, Importing the foods that the sellers will not sell them to customers directly,such as raw materials,foods for embassy only,exhibitions,samples (shall provide detailed proof materials), and duty free foods, the importer/distributor should apply to the inspection department for not applying chinese label. And the importers should provide the exemption certificate,commercial invoice,packing list,contracts and L/C and other required documents when they apply to inspection department(as above)  

Third, to imported special food, the importer/distributor should obtain “import and export pre-examination certificate” before entering into China .For details, please login entry-exit inspection and quarantine website. At the same time,they should apply to inspection department to put on record their Chinese label. The Chinese label must be designed base on the standard GB7718-2004 and GB13432-2004.For details, please login the website of entry-exit inspection and quarantine.

When the goods arrived at the port, the importer shoul prepare the following documents for applying to inspection departmen:

1.Chinese label (already put on record)

2.Commercial invoice

3.Contract/ LC

4.Packing list

5.Other documents required by the inspection departmen.

Fourth,to import additives, the importer should not only provides related documents like regular foods, but also provides instructions for use., besides the ordinary food and provide relevant information, provide the purpose statement issued by the consignee, imported with food additives (not including fragrance, flavor, and shall also provide production enterprise with ingredients list, according to the additive was decreased with order list, imported ingredients list for specific purposes of food additives, also should provide related products after entering the use of purpose and direction.

Fifth, the importers/distributors should obtain the sanitary certificate which isueed by the inspection department first before they start to sell the goods in chinese domastic market.
